HMRC consultation framework

HMRC has announced a formal framework to apply to all UK public consultations. HMRC aims to consult more often and on a timely basis and to achieve broader participation from interested parties. The framework covers formal and informal consultation on areas of operational policy, administration and legislation.

In planning consultations, HMRC will consider the following points:

What type of consultation will bring the best engagement?
Ministers will retain their existing discretion on how to consult. Consultation routes should be easily accessible. Where major change is planned HMRC will undertake a formal UK Public Consultation under the Cabinet Office Code of Practice. Where appropriate HMRC will start early informal consultation and use this to inform later formal or informal consultations.

Who should be consulted?
HMRC will identify key stakeholders in the proposed activity and ensure that they are included in the consultation. Where possible, more than one route will be chosen to reach the target audience.

What information is needed?
HMRC will ask focused questions and be clear about the area in which views are being sought.

What is the timescale available?
Consultations should be for as long as either possible or agreed. Written consultations should aim for at least 12 weeks or indicate why this timescale could not be met.

How will feedback be given?
Where possible, prompt and full feedback will be given in order to encourage participation from stakeholders.

HMRC recognises that time given to participate in consultation is voluntary. In order to encourage stakeholders to participate HMRC will aim to

  • prioritise which changes require consultation;
  • ensure early engagement;
  • appreciate the need for the 12 week turnaround; and
  • take steps to deliver consultations on connected areas together.

HMRC also have a consultation co-ordinator whose role is to help colleagues to successfully conduct consultation exercises.
